2. Subject matter

These Terms and Conditions govern access to, browsing of and use of the website https://driveweb.pt/, as well as the conditions applicable to the services provided by Rodrigo Soares dos Santos / DriveWeb.

3. Services provided

Through this website, DriveWeb provides digital and technical services, including:

website design;
development of professional and optimised websites;
WordPress plugin development;
Perfex CRM module development;
payment integrations;
bespoke digital solutions;
technical maintenance;
digital consultancy;
optimisation and technical support for web projects.

DriveWeb reserves the right to change, update, suspend or remove services, functionality, content, prices or commercial conditions, without prejudice to contracts already entered into.

4. Pre-contractual information

Before any contract is entered into, the customer will have clear and understandable access to essential information about the services, including their description, price, payment terms, estimated completion time and contact details.

5. Contracting process

Services may be contracted through direct contact, a form, proposal, quotation, exchange of emails, written message or another means accepted by the parties.

The contract is considered concluded after:

the customer’s request;
review and validation of the request;
acceptance of the commercial conditions;
acceptance of these Terms and Conditions, where applicable;
confirmation of the initial payment, deposit or full payment, where applicable.

DriveWeb may request additional data, access, documents, materials or confirmations necessary for the service to be carried out correctly.

6. Prices

All prices shown on the website are in euros (€), unless stated otherwise.

Where applicable, the customer will be told whether the stated price includes VAT at the statutory rate in force.

Additional costs for domains, hosting, licences, third-party services, APIs, payment gateways, extra maintenance, support not included or requests outside the initial scope will be communicated to the customer in advance.

7. Payment methods

Payments may be made using the methods made available by DriveWeb, including, where applicable:

card;
Multibanco reference;
other integrated or agreed payment methods.

The availability of certain payment methods may depend on technical, geographical, commercial or contractual validation.

8. Timeframes and service conditions

Completion times vary according to the complexity of the project, the services contracted and how quickly the customer supplies the content, approvals, access and other elements required.

Unless a proposal, quotation or contract states otherwise:

timeframes are estimates;
work begins after the request has been validated and, where applicable, after payment has been confirmed;
customer delays in supplying materials, access, approvals or responses may directly affect the final timeframe.

Services are provided mainly digitally and remotely.

9. Customer obligations

The customer undertakes to:

provide true, complete and up-to-date information;
provide the materials required to carry out the project;
respond within a reasonable period to DriveWeb’s requests;
make payments by the agreed deadlines;
not use the services or website for unlawful, abusive or illegal purposes.

10. Intellectual property

Unless stated otherwise, all website content, including text, design, structure, images, graphics, code, brands, visual elements and materials produced by DriveWeb, is protected by intellectual property rights.

Without prior written authorisation, its reproduction, distribution, modification, publication or exploitation for purposes outside the contract entered into is not permitted.

For commissioned work, the transfer of rights of use will depend on what is expressly agreed between the parties.

11. Limitation of liability

DriveWeb is not liable for:

third-party failures;
unavailability of servers, platforms, APIs, gateways or external services;
temporary website interruptions;
delays caused by force majeure;
damage resulting from misuse of the services by the customer or third parties;
blocks or limitations imposed by external platforms beyond its control.

To the extent legally permissible, DriveWeb’s liability is limited to the amount actually paid by the customer for the service concerned.

12. Right of withdrawal

Where legally applicable and where the customer is acting as a consumer, they may have the right to withdraw within the statutory period of 14 days.

However, this right may not apply or may cease in the cases provided for by law, including where the following are concerned:

services started with the customer’s consent;
services fully performed;
personalised or bespoke services;
digital content supplied after authorisation to begin performance;
technical work specifically developed for the customer.

13. Cancellations and refunds

Cancellation or amendment requests must be sent in writing to contacto@driveweb.pt.

Without prejudice to applicable legal rights, no full or partial refund will be made where:

the service has already been wholly or partly performed with the customer’s agreement;
the project has started after express approval;
the work is technical work, bespoke development or a tailor-made solution;
the customer does not provide the elements required for performance;
there are external dependencies beyond DriveWeb’s control.

Each case will be assessed according to the nature of the service and the stage it has reached.

15. Alternative Consumer Dispute Resolution (ADR)

In the event of a consumer dispute, the consumer may refer the matter to an Alternative Consumer Dispute Resolution body.

16. Personal data protection

Personal data collected through the website will be processed in accordance with applicable data protection legislation, solely for legitimate purposes, including:
